Google has recently taken a stand against low-quality listicles that manipulate search results and mislead users. These so-called "best of" or "top X" lists have become a popular tactic for companies to boost their visibility in search engines and even influence AI-generated answers. However, with the enforcement of the FTC's Consumer Review Rule in October 2024, such practices are now not only a search-quality issue but also a potential violation of federal regulations.

The FTC's Consumer Review Rule, specifically outlined in 16 CFR Part 465, prohibits several deceptive practices tied to reviews and testimonials. These include presenting company-controlled content as independent reviews, publishing reviews of products or services never actually used, and attributing reviews to people who didn't write them. Penalties for violating these rules can reach up to $53,088 per instance, with each page counted separately.

Lily Ray, a LinkedIn contributor, highlighted the growing concern over these listicles in a recent post. She noted that "best X" and "top 10 Y" listicles have surged as a search engine optimization (SEO) tactic over the past couple of years. These pages often perform well in search results and increasingly influence AI-generated answers, raising concerns about the integrity of the information being presented.

The issue isn't new, but it has become more pronounced in recent years. Before the FTC rule was formalized, at least one company faced legal action for publishing hundreds of "best of" pages that ranked its own services at number one and included fabricated competitor reviews. The Better Business Bureau later censured the company for unsubstantiated claims.

Many modern listicles follow a similar pattern: a brand publishes a "best tools" list, includes competitors it hasn't tested, uses subjective or invented scoring systems, and ranks itself at number one. These listicles may imply independence or firsthand evaluation when neither exists, leading to confusion among users.

While it is possible to publish comparison content that includes one's own product, the risk of violating FTC guidelines increases when:

1. The content implies objectivity but promotes the company's own product.

2. The reviews presented are not based on real experience.

3. Material relationships are not clearly disclosed.

Google is aware of the low-quality listicle trend and has taken steps to combat it. In a statement to The Verge, a Google spokesperson mentioned that the company applies protections against manipulation in both Search and Gemini, its AI-powered search engine. These measures aim to ensure that search results are more accurate and trustworthy for users.

As the FTC's Consumer Review Rule continues to be enforced, companies that engage in deceptive practices risk facing significant fines and damage to their reputation. With Google also taking action to protect search quality, the days of low-quality listicles dominating search results may be numbered. The focus now shifts to creating transparent, informative content that benefits users and aligns with regulatory guidelines.
